I wanted to know ...if i get pulled over by a police officer ....asks me for my papers to just check my car... and asks me to pull up my front windows....what if i refuse ?
what can the police officer do ?
Now remember ... i never had my windows up ( always down completely ) and my electric window module doesnt work.... can he give me a ticket or even try himself to raise my windows?
Personally i dont think he has the right to do it himself...dont you need a warrant or something?

As of now, there's nothing we can do. Our first motive for giving tickets for tinted windows or an inspection for tinted windows, we must see the vehicles windows and have trouble identifing the occupants or being able to see easily inside the vehicle.

If the front windows are down, we don't have any reason to suspect that the windows are tinted.

But you can't always drive with the windows down.......

Recently, I spoak with an expert on the matter at the National Police Academy. He's looking into the problem where someone refuses to pull down his window or refuses to open his door to help the officer make his tests with the tint meter. What he told me is that eventually we will be able to charge these people with a criminal offence on interfering with the work of a police officer. But this is just preliminary info. It might be the same for someone who refuses to pull up their windows.

If you refuse, he'd probably arrest you or something. They're cops, they think they can do whatever they want.

logik23 ... that was not logic, and neither was it at a 23 year old's level.

But i'm sure he can charge you for something... not that it might be good in court, but municipal judges are mostly always on the cop's side unless its really obvious they are wrong

What logic23 just said may not be logical, It is most definetly TRUE. Thats how the cops are and act around Montreal. If they want to give you a ticket youll get a ticket, whether you did something wrong or not!

mise en situation : (policier arrete un jeune pcq ces fenetres sont abaissées et qu'il veut tester le tintage)

policier: may I ask you to pull up your windows please sir.
accusé: why so?
policier:because i need to test the tinting of 'em.
accusé: okthen. but i cant pull em up sir, the electrical module is broken.
policier: (pulling out his gun pointing at the accusé's face)
SIR. I SAID PULL UP YOUR WINDOWS. IF YOU REFUSE TO DO SO, AS A MATTER OF NATIONAL SECURITY, I'LL BE IN THE OBLIGATION OF HURTING U AS SELF-DEFENSE FOR ME AND THE OTHER CIVILIANS!

can't you just send them for an inspection?

If they have nothing to hide, they'll just pull up the windows and test will be done quickly.

I wont send someone to inspection if I have the tint meter with me ...

And exactly, if someone has nothing to hide he wont mind pulling up his windows... but well all know that there are a lot of wize guys around...

Plus, almost all front windows that are tinted are illegal.

what i mean is if he don't want to pull up the window or pull down to do the test, you said, there's nothing much you can do, can't you send him to the inspection?

Well I have to see the window to determine if the window is too tinted. So if the windows are already up, at the limit, YES I could send the car to inspection.

But if the windows are down, I don't have any mitive to send the car to inspection since I didn't see the window.

If I remember right it was mentionned in another thread that a cop can send you to inspection if you refuse to let him tests your flashers or whatever. Couldn't they do the same thing if the driver refuses to let you test his windows?

For one it’s really annoying, and a waste of my time. What if you get pulled over 3times in a day for tints inspection...?

But I understand I might be harboring terrorist in my back seat right? Its all for security reasons...

Pure BS.

If you get pulled over 3 times a day... theres something wrong with you for sure.
Hell if you get pulled over 3 times a week theres something wrong with you.
