First Infraction - Excessive speeding (verbose post ;) )

Just my luck/stupidity/divine mandate..

I'm driving along a familiar route coming back from the passport office and dropping off a relative. I suddenly get a phone call asking me to joing an urgent conference call at work (I had taken a couple of hours off to go do the passport thing) . I accelerate off a stop sign, pass a green light and stop at the next light (which had turned red moments before i got there. At that stage i knew i was speeding somewhat but nothing so extreme as to prevent me from stopping at the light.

I turn left at said light an suddenly a motorcycle police officer pulls me over. The officer is visibly upset and begins lecturing me , in a fairly animated manner, about excessive speeding and informs me that I was doing 85 in a 30 zone.

Ok before everyone jumps at this, i know what i did is stupid and sounds semi-criminal but the area used to be a 50 zone in the past (not my excuse, just helped build a bad habit of mine). In any case, the officer continues on to tell me that he recorded my speed using a laser detector and proceeds to take my license, registration and insurance and goes off. He then returns with a lovely ticket for 718$ and 10 demerit points to which i react with utter shock (at that time, i am still unaware of loi 42). So he , just short of yelling at me, lets me know that "everything doubles when you're a certain speed over the limit") and at that moment i politely thank him and he goes away. I drive my relative home and go back to my office in shame.

Needless to say it put a damper on my birthday plans (happened the day before my bday) and i missed the work engagement.

Now if you've read this far and arent screaming "you deserve it you crazy maniac!!1!!" I would like some opinions. I fully intend to pay for the ticket as I am certainly "guilty" of being over the speed limit but I am not too convinced that I was , in fact, doing 85km/h. Nevertheless, my question is as follows. Since this is my very first infraction (short of 2 parking tickets) ever, Is it worthwhile considering contesting it to get the demerit points reduced and avoid any drastic insurance increases?

I know my actions were stupid and I've certainly learned my lesson. Just need opinions on whetehr to shut up and pay up or try and explain and see if i can get leniece.

Your opinions on the matter would be much appreciated.
 
thats a tough situation a friend of mine got that same ticket, 120 in a 70... i find those new laws way too harsh however they make you think twice before nailing the gas. Id just pay the ticket and get it done with, be careful from now on cause you only got 5 points left!
 
Well, you live in St-Laurent so you are more than aware about the school zone. I drive there everyday and Ive never seen someone drive 85. 718$, Hope that you will learn your lesson.
 
Mon premier tiket a ete supposement 101 dans une zone de 60 j'avais 16 ans et naif de comment le system marchais anyway quand je suis parti au stop jai acceleré comme d'abitude jusqua 80kmh mais qqchose comme 10km plus loin jme fait arreter comme quoi javais depasser les limite mais encorre la j'y croient pas et jaurais du le conester..

tous ca pour dire que tes aussi ben mieu de le contester essayer au moin comme ca tu regrettera pas d'avoir rien essayer...
 
it's funny, your speeding to get there faster and you miss the engadgment because of that speeding.

anyway, you can contest and ask for the proof. You'll see if it's in fact a 85kmh taken with a laser. If it is.. well.. more fees, if not, you'll save a couple of things. excessive speeding for 30kmh zone is 80kmh.

If it's true you were that high in a 30kmh zone, i hope you pass elsewhere at least next time your speeding.
 
You would have needed to be driving under 76km/h to get a lesser fine and I'd say it's pretty unlikely the cop screwed up that badly.

In all honesty, the prosecutor has you by the balls. Driving that fast in a school zone is a pretty serious offense, I can't see why they would wanna go easy on you.

Don't bother showing up in court. You'll lose a day of work ($$) and pay extra fees if you're found to be guilty as charged.

And just so you know that 700$ fine is just the beginning. You'll have to pay an extra 280$ over the next 2 years for your driver's liscence renewal (200$ a year instead of 60) and your insurance company probably isnt going to like that too much neither if they find out.

It's 40 over the limit when the speed limit is 60 or lower, so 70km/h in this case.
 
You were either on cote vertu or thimmens most likely and they both turn into 30k/m during rush hour and lunch. Just pay it and consider it a lesson learnt.

I was actually on Poirier just before Cardinal. Not sure there's a school there. Couple o churches and a baseball field.

Starting to sound liek opinions are split on contesting this. Any ideas what the fees are ? I have no intention of debating this matter with a judge; prosecutor deal out of court, maybe. Not too sure that the fact that it's my first and only offence can mean anything...
 
My opinion is partial .

What time of the day was it ?
How was the traffic?
Was people on the sidewalks ?
How was the weather ?
Were you in full control of you vehicule ?




Get an attorney to help you out .
In a sarcastic way : the officer should have tased you ...yu'r
a dangerous criminal ....next time the speed talibans will
cut your right foot ....take it for granted ....the official discorus ....
It looks like an officer is letting someone shoot someone,
only arrest him after the fact while he was in power to stop the crime ....

For the future : learn how to protect your permit ...
Learn how to fight the Speed Talibans ....
I don't promote speeding while endangering other's life or yours ...
I promote intelligent and safe speeding at the right place in the
right time against across the board blind speed ruling taken out
of context ....

ayoye.. encore parti... c'est vrai, j'encourage de rouler 300kmh dans une zone de 30 quand y'a aucun danger vu que... y'a aucun danger!

Egalement, y'aurais du bruler les lumieres et les stops, y'a aucun danger. mais non, ils les a fait, parce qu'il n'avait pas les informations necessaire pour remarquer si quelqun pouvait arriver, il n'avait egalement pas l'information necessaire lui permettant d'affirmer que personne ce trouve dans la zone de 30kmh. La meme zone que des pietons, cycliste peuvent circuler supposement l'esprit tranquille.

Par rapport au plein controle de son vehicule, on sait qu'il focusait sur le fait d'arriver a son rendez-vous rapidement et non sur sa vitesse reele.

Anyway, je vais arreter la comme ca ta reponse philosophique sera un minimum limitée.
 
Use a lawyer and reduce the points. You have two years at 10 points - that's not a lot of room for mistakes especially with the new laws. You obviously didn't intend anything reckless - this is just normal Quebec driving habits and it's going to take some time for everyone to adjust.

non pas besoin mais

dans une zone residentielle avec des eglises (pas de prejuges mais souvent relate, ca veut dire des personnes agées vivant proche) limitée municipalement a 30kmh j'appelerais pas ca de la vitesse prudente dans un bon lieu ni dans un bon temps vu que le secteur n'etait pas "boucler". Une piste de course s'y appliquerait beaucoup mieux.

For the sake of completeness, the answers are:
-9:03am
-No cars on either sides of the road i was on. A couple on teh intersection where i stopped(on the cross street)
-No people on the sidewalks, a couple inside a bus shelter.
-Blue sky, dry roads
-I stopped safely at the red light, full control of the vehicle.

I trust that everyone knows that neither Aze or I are promoting excessive speeding in a 30 zone, just trying to clear up the matter in case anyone's opinion on contesting this may be better informed by knowing the conditions listed above.

Again, I thank everyone for their opinions and guidance on this matter.

Having driven for over 5 years and this being my very first offence and quite the wake-up call, i doubt that I will have an issue with driving two years with "only" 5 points. However, I understand and appreciate your comment and am certainly interested in getting the points reduced if possible for insurance cost reasons.
