I have a friend that lives on the 2nd floor of a 5 floors condo building !
So last night we were having a few drinks ...when suddenly I start hearing really heavy steps from the 3rd floor ! I'm all surprised and he's like bleah ..it s ok!
The kids upstairs were running in the house ...it sounded like the 3 world war !Have no idea how you can make those sounds! lol ! I was all surprised...and I asked him if he did anything against ! He said he already spoke to the parents a few times...but that they continue to do the same thing !

Is there anything he can do ...or just shut up his mouth ?
I told him call the cops..but I really doubt it s a good idea...they can t do much ...

Tks guys

Article 1063 of the Civil Code of Quebec contains the following principle:

Subject: Divided Co-Ownership (condominium)

Article 1063: Each co-owner has the disposal of his fraction; he has free use and enjoyment of his private portion and of the common portions, provided he observes the bylaws of the immovable and does not impair the rights of the other co-owners of the destination of the immovable.

No one escapes the consequences of civil liability. Co-owners will be held responsible for the damage they cause to others or to the common portions...

> So, I would warn them with a written consent & give a copy to the "syndicate" of the divided co-ownership of the immovable (condo)
> Wait 30 days or so, if nothing improved,
> Worst case scenario; file a Civil Suit.

etc...

In the Civil Code they say "something" protecting pregnant women and their children... But in your case, I don't think its a factor...

Why the hell would he buy a condo that isn't sound proof?

Anyways, get a broom handle and hit the ceiling until they control their little shits.

Or get them to buy carpet.

I will tell him about it ..but acording to this ...looks like there's not much he can do ! You will need proofs...

Nobody with such experience?

I really doubt u can buy a condo that isn't sound proof! By law I think the minimum ceiling is 4po.
But come on ! If you start jumping all over ur floor it could be 12 po...and u will still hear it

There's plenty you can do LEGALLY and ILLEGALY :)

Legally: File that civil suit with "proof" (little mpeg or avi vid)
Illegally: Force them to MOVE OUT, in any way, shape or form... ;)

Illegally is longer than legally as a word...but sounds easier...

Are they the owners like you ?

Because most cases its its the landlord against the tenant, but this isn't the case !

Verbal warning means s**t, send them a registered letter, once, twice and then forward it to the condo committee when they have their monthly meetings !

Tell him to sell his condo and buy the one on top of them and then throw a party every Saturday night and invite you MR buddies so we can wake their kids up in the middle of the night with our music and all the chicks cheering till the parents become braindead. long sentence I know. Seriously begin with the syndicate and bring up respect of the neighbours in the next meeting.

wtf?

It's called cement. Any half decent condo or good apartment is sound proofed.

The kids dosent run at night right?
So let them grow up. People are so intolerant these days, we live in society. If is condo is not to is needs, you can also move out. But it seem its ok for him but YOU want him to call the cop ?????

why would you file a civil suit against a family?

was wondering the same thing...

just tell the kids if they keep running around youl take one of them and tie him up in your trunk or some shit
:) i ll make him read this

I told him 2 call the cops...just 2 scare them a bit ! Cops can t do shit about it anyway! But u never know...

cement doesnt sound proof, if anything it helps vibrations and noise travel from what ive seen in apartments.

uuummm......ok

I live in an apartement that isn't cement or concrete or whatever it's called and it's noisy as hell.

My dad used to live in a concrete building and it was whisper quiet.
