SPVM ticket sur l'autoroute // SPVM highway ticket

Je veux simplement savoir si ils ont le droit de donner un ticket sur l'autoroute, sinon, pouvez vous me dire quelle est le numero de l'article ?

I would like to know if they can give me a ticket when im on the highway, if not, can you tell me the number of the article ?

Basically they can't set up a speed trap but if they are traveling on the highway to get from Point A to Point B they can stop you.

As far as stopping you on your own property. I'm pretty sure that's a lie. Sure if you do something illegal they can come on your property but the CSR/HSC designates it's boundaries with it's first clause as:

This Code governs the use of vehicles on public highways and, in specified cases, on certain private roads and lands, and pedestrian traffic on public highways.

i.e. Shopping mall parking lots and roads where public traffic travels. So feel free to do some burnouts in your driveway with complete immunity*


*will not be held responsible if you do and have legal problems because of it.

I believe what he meant (i could be wrong) was that if you commit an infraction and the police sees you, but you have enough time to pull into your driveway by the time they catch you, they can still give you a ticket.

As for the burnout in private driveway: immunity regarding HSC, yeah, but you could still get a ticket depending on municipal regulation... Be careful.

Do you mean that they can't set up at trap on the highway? That so weird because I always see police trap on highway 132. Like 3-5 police there immobilize with a laser gun pointing at the cars.

Montreal police cannot set up speed traps on MAJOR highways, i.e. 20,40,15,13,etc. Some triple numbered highways are basically streets. Those I wouldn't be surprised.

Well 132 highway is the longest highway in Quebec and if you want the exact location it`s between Exit 3 and 6 (132 West , 15 South). Speed minimum 60 , Max 100. Is this consider a major highways?
 
La poursuite doit faire la preuve que le policer était en fonction.

Et de deux ... doit faire la preuve que le policier empruntait l'autoroute pour faciliter ses déplacement.

Un avocat pourrait t'expliquer ce que signifie ces deux points.

Read properly.

The 132 is not even in Montreal, so obviously it's not part of the SPVM's territory... The SQ covers it and they're allowed to set up "traps". And it's considered a major highway because at this place, the 132 is actually the same as the highway 20.
