Alberta farmer who shot ATV thief will go to jail

A central Alberta farmer who shot a man stealing his ATV more than two years ago will serve 90 days in jail.

Brian Knight learned his sentence in a Red Deer courtroom Friday after pleading guilty to criminal negligence in January.

Justice Monica Bast rejected the defence's argument that the shooting was impulsive, saying she believed Knight was aware to some degree what he was doing.

Knight chased and used a shot gun to fire at a man who was stealing Knight's ATV from his farm near Tees, Alta.

In the early morning of March 26, 2009, Knight found three men in his farmyard.

He jumped out of bed and gave chase clad in boxer shorts and rubber boots to a man riding Knight's all-terrain vehicle.

Knight rammed the ATV with his car and, when the man abandoned the machine and began running, Knight pulled out a shotgun, firing two rounds at him, police said.

The man, who suffered non-life-threatening injuries, was eventually caught after Knight called friends and relatives to help in the search, police said.


Must send message, says Crown

Crown prosecutor Jason Snider recommended Knight be sent to jail for 90 days to be served intermittently.

Snider told Justice Bast the shooting was a vigilante act and the court must send a message that behavior of this sort is wrong.

However Knight's lawyer, Balfour Der, argued the shooting was not a vigilante act, but a spontaneous reaction.

Knight did not shoot to the man to kill or hurt him, but merely wanted to scare him, Der said.

Knight's sentence will be served on weekends beginning after the Thanksgiving weekend.

Left wing justice for you right there. It's ok to steal others belongings but it's not ok to protect your property.
 
Nah man....you don't just shoot a guy after he abandons your shit....guy gave up the ATV, started running, then got shot..... not cool. i hate thiefs but common.
you dont shoot a guy running like a rabbit...even if you really think he deserves it.

even if the dude was still on his ATV... dont really think you can shoot him... its like if you see a guy stealing your bike...are you gonna fucking shoot him? .instead of calling the cops, or try to chase him without using your fucking gun?

Life is priceless...worth more than an ATV or a bike.

Dude deserves his jail sentence...but 90 days isnt enough. welcome to Canada, eh! Rednecks should stay away from guns.
 
I am actually for a "Castle law" where if someone comes into your house, you can defend yourself with deadly force without fear of going to jail.

That being said, if the article here is accurate, the thief was actually running away when he was shot ... I don't think he should have shot him. If the thief came after him with a knife or whatever that's a different story.

Exact, sa vie n'était pas en danger donc aucune raison de tirer le voleur. Si tu veux tirer quelqu'un pour te venger ou évacuer de la pression alors tu ne mérites pas d'avoir des armes.

Nop, you commit a crime, put people at risk, you deserve to get shot. This is how we compromise everything. Drs killing their 3 kids don't get a day in jail, although a man defending his property gets jail time.

The amount of insanity from you is increasing day and day.

You don't make a godly decision over the life of somebody like that. It's not even a violent crime. You value objects more than a life. The guy may be a father, was having a rough patch, has a family, a mother that loves him. You don't simply die over a bad decision that have little consequences.

Yep exactly. Nowadays, crooks knows that most of the time the police won't do shit. So they steal countless times because they don't have anything or anyone to fear. However, as soon as they realise that people may actually start to defend themselves, then they'll think twice about stealing your things. They'll ask themselves "Does this VTT is really worth taking the risk?".

This week I've been robbed for the third time at my dad's cottage. That's enough. I'm planning to catch them by setting a "trap". I'll then do a citizen arrest since the police is only useful at giving out tickets.
 
Si quelqu'un vient sur ta propriété fucké avec tes affaires, c'est qu'il le sait en calice qu'il a pas d'affaire là et il mérite justement ça. C'est justement parce que le monde ont pas peur des représailles que plein de monde honnête se font voler des chars / affaires / break-ins / abuser etc.

Ils veulent faire du fermier un exemple en l'envoyant en prison wtf. Ok je suis pas full d'accord avec le fait qu'il ait tiré le gars après qu'il a lâché le VTT; il aurait dû le tirer pendant qu'il était dessus.

L'autre osti de sans-dessein "il avait peut-être un rough patch" f*ck you. Quand j'ai eu des rough patch moi jsuis pas allé voler du stock chez les voisins calice j'ai travaillé plus puis j'ai passé à travers. Aller voler d'autre monde qui travaillent pour leur osti d'affaires juste parce que toi t'as de la misère, argument d'attardé.
