Norman Osborn is a ruthless billionaire who is better known for being the original Green Goblin. He is one of Spider-Man's greatest nemeses and caused many tragedies for the hero such as the infamous killing of Gwen Stacy.
After the Daily Bugle exposed his secret identity to the public, he's done everything he can to seperate himself from his alter ego. He was in charge of the Thunderbolts which tracked down and forced every superhero to register in the Superhuman Registration Act.
When Asgard was falling to earth, Osborn created a new persona called the Iron Patriot (a combination of Captain America and Iron Man, forming a new team of Avengers, The Dark Avengers, along with it. He eventually decided to invade Asgard claiming that it was a threat to national security. Tony Stark managed to remove his armor and brought an end to Osborn's "Dark Reign" during the battle for Asgard.

On-set images of filming for the 2013 film Iron Man 3 reportedly showed actor James Badge Dale, as Eric Savin, wearing a battlesuit similar to the Iron Patriot armour, but in fact it was a stunt double for actor Don Cheadle. War Machine has been given a new paint job, as evidenced by officially released photos of the armor featuring the name Lt Col James Rhodes printed on the chest.
ce qu'on peut voir aussi ces le gun sur l'épaule qui est typique de war machine. En plus que iron patriot a vraiment une etoile au centre et celle la est juste peinturé ces un rectangle le source d'énergie

After a bit of research, it will in fact be War Machine and not Iron Patriot. They simply gave him those colors, but a quick look back to a scene from Iron Man 2 where James Rhodes puts on the blank/non-painted Iron Man suit reveals a good hint. Stark says "You wanna be the War Machine? Take your shot!" Not to mention "War Machine" plays a large part in the action scene.
If we simply put aside the color scheme, it follows the story much better than the other way around (it being Iron Patriot). This should also explain why we haven't seen a cross over with the Spiderman Franchise (Normand Osborne/Iron Patriot) to which Marvel Studios did not have the rights (Sony had the rights).
