So my car got rear ended 3 months ago and it was parked beside the curb so the driver side wheel ended up hitting the curb and something broke resulting in the wheel to fall out. The person that estimates came and said it's it's write off and they towed the car. 3 months pass and now they say there gonna bring back the car and they're not responsible for the damage in the front because the car was already accidented at the same place and the metal was probably weak and that's why it broke so easily. The car is worth 8500 and they only want to pay me 2000 for it. The car is a vja and I did all the inspections at the CAA so I could even plate it 5 months ago. The person in charge of my claim says a lot could have happened in 5 months lol.... they want pictures and matenence bills which I don't have. it's been going on for 3 months and I don't know what to say any more.. any advice would be help full cause now they towed the car to my house because apparently they can't keep paying for storage.

fixed:

What do you expect?
They are right anything could happen in 3 months even in one day...
And how do you know you car is worth 8.5k?
Ohhh and what is your car btw?
I think it's your fault... You waited to long buddy and don't expect getting your 8.5k

dejardins is saying according to they're " investigator" after 3 months of calling and asking them whats going on any updates finally made the decision that metal on the control arm was weak since the car was previously hit around the same area couple years back. the car was from ontario and to be plated in quebec i was forced to do both a visual and mechanical inspection by the saaq and the car passed back in september.

If the car is worth what you say it is, cut your losses and take whatever money they give and keep the car, part it out, and move on. Time = money, get your car back and whatever they give you.

if insurance pay for a vga car=you don't keep the car...just sayin

^^you can buy it back from the insurance for not much.

So what's the damages really? front wheel and suspension that's it?

Insurance tried to write off my `98 Sidekick last fall because of a battery theft/damaged soft-top. This is my truck:

I told them to fix it or they'd lose all my business, four cars (at the time, I just sold one) and home insurance.

They had it fixed. Damage was 1700$ including a new top.

You should fight for it but from experience (my mom) Desjardins isn't an insurance company, it's a fraud company as they'll always try and rip you off as much as possible. They screwed my mom out of two claims before I convinced her to change insurance.

The best was when her house got robbed, thieves broke down the front door, door was okay but the frame was wood (a nono for an entrance, make sure it's metal) so after she made a claim for the stuff that was stolen she also made a claim for the door, they refused to replace it, wanted to REPAIR a wooden doorframe with glue.

That'll hold...

You have the right to contest and ask for another estimator...
I dont understand why people still do business with Desjardins. They are crooks. Expensive. Asses when you make a claim. They will do anything to not pay you.
