Police officers kick door down and use tasers (California)

Situation Perdant-Perdant, catch-22 , damn if you do, damn if you don't

They didn't have a warrant and broke in. Is your head that far up your ass?

I can think of dozen of examples of situations when you do not need a warrant to break in and, most importantly, don't have time to wait for a warrant...

Let me provide you with a very simple example:

If you were tied up in your basement while someone is in your home stealing your stuff or abusing your family and someone called the cops, you would be ohhhh fuckin' happy they didnt wait for a warrant to break in.

The case you just described has probable cause. There are certain cases where police can bust in without warrant example destroying evidence. If they can prove they knew you were destroying/flushing/hiding evidence then they could bust in on the grounds that time was of the essence.

In this case they cited domestic violence as being the reason for their presence and when the man and woman stated there was no domestic violence the cops should have fucked off but their egos were hurt and only kicking down the door and tazing could re inflate them.

I hope they get a mega settlement and these a-hole cops fired permanently.

Regards,

OK, but how are you suposed to make sure everybody's safe if you don't come in ?

It's easy for a guy beating on his wife to tell her she better tell the cops everything alright or she'll get another beating. It happened in the past and will happen again...

Officers have to come in to make sure no one (a suspect) is hiding somewhere in the house until they leave. Going in also allows the officers to take a look at the environnement.. If they see signs of fighting, it can be a clue that there was indeed domestic violence prior to their arrival on the scene.

See, that's just another case of whatever the cops will do will be used against 'em. If they come in, they're assholes and need to be fired 'cuz they violate people's right. If they don't come in and some woman gets the beating of her life, then the cops will be blamed 'cuz they didn't do shit....
