Exhaust ticket

So this morning i got a ticket for "being the owner of a motor vehicle equipped with an exhaust system that is not in conformity with the standards set out bu regulation"

Now i know we have new laws where the police are equipped with db readers but this police officer came out, took no reading but measured my pipes with a tape measure lol. He said, they weren't stock pipes therefore illegal. $160 ticket. Now, i thought the new laws were in place because people were contesting moto exhaust tickets and winning therefore they needed to start doing db tests. I'm thinking of contesting it, you guys think i have a shot?

From reading your other post about the fact that you need to shut the engine off to ear someone talking from a couple feet.....you have loud exhaust and deserve your ticket.
 
a couple of feet? He was across the street on a busy street with cars passing by and i had my helmet on. He was talking out his window. On the SAAQ website it states that DB meters go into affect May 2013.
 
Try to contest but i dont know anyone that won for an aftermarket exhaust

Actually, this is why they imposed the db laws and require cops to carry db readers now. The laws were too vague and people were getting off easily.
 
loud pipes save lives......I budget for 1 exhaust ticket a month all summer. :) I aint changing it

LOL i told the cop exactly that. Another bike had passed with stock exhaust and the cop said, well that guy has stock pipes and he is alive. I told the cop straight up, you don't ride do you? I said, you can give me the ticket but i won't change the exhaust. I like being loud because other drivers notice me.

It's funny because i notice a HUGE difference in drivers attention compared to when i was riding sports bikes with stock pipes. A lot of times they will hear me and give me the right of way instead of just encroaching in my lane or cutting me off completely.

So should we eliminate horns on bikes and cars? Loud noises make no difference right? I guess they don't on farms but try driving in the city every day including hours in high traffic areas.
 
So how long have you been riding?

14years for me..and last 6 year goind to work every day downtown from the south shore.

Had 2 "loud pipe" for a total of 3 year....it was the best thing ever for about 1month with the first one I got when I was 20.

Now they totally pisses me off...
I'm still alive and never been cut over more then when I had one.

So stop whining and pay your ticket!
 
10 years with all 10 years riding to work in Old Montreal. First from Pointe-Claire, then from Pincourt and now from DDO. I put more KM on my bikes than my car. I'm 37 and have no issue with the pipes being louder than stock. I did a little research and these pipes show a reading of 94db at idle on a sportster. That right there wouldn't have been a ticket. There is no way he could of tested me at 2500rpm because i have no tachometer so that test would have been invalid. I am not whining at all but cops like to play by rules (and they also like to make their own up) so why is it any different for us regular citizens? Is my exhaust illegal? SURE...but the new rules state that to be illegal on a motorcycle a reading of over a certain amount of db has to be shown. He did not test for that so why should i spend $160 of my money on something i can get out of?
 
94db @idle..LOL!

you know that stock is around 85db?
and the sound human feel "double" every 3db?

the "law" will be ~93db.

giving a ever so slight amount of rpm would make your db rating jump to 96+db.
No having a tachometer doesn't change anything.

you're already busting the new "not enforce yet" rules!!!

the new law isn't in force yet...so aftermarket exhaust = ticket!

was about time to install a db law ....even racetrack doesn't allow more then 98db @ 2/3 of the rpm range.
You would be busting it at 1/4 throttle with your bike!

It is in effect but some cops are not equipped. For cops an aftermarket exhaust = ticket whether it is 85db or 100db. The cop that stopped me never mentioned noise..he just said i had an aftermarket exhaust. I am also not a fish that will just give into anything the government decides to throw at me. I will fight it..if i lose i pay, if i win i don't pay but i will try.

Anyway thanks for your two cents. I get your point. We all have to abide by the law....even the most ridiculous ones imageable. Still, i'll fight it....it's not even a money thing. Some people pay their tickets right away and some fight them...some cops will let you go and tell you you have a nice bike whiles others will ticket you for anything and everything.
 
I have an after market exhaust on mine, and its not super loud but loud enough to notice a different attitude from cars on the road. Saying that REASONABLY loud exhausts dont make a difference on the highway is a little unfair though, there is no proof that it could save a life but if it allows someone to think twice before changing lanes without looking closely then why not. And please dont use some of that riding experience to counter argue, Im a very safe and aware rider and I still find some idiots on the road not paying attention, if my exhaust can snap that person off that moon he's lying on or that cell phone he's texting from (yes I still see some of those idiots very frequently) then I'd rather have it then not. We can be evasive if needed by why need to when someone notices you before something stupid can happen. Some of us can have exhausts without being douchy about them, its the douchebags that make it annoying for everyone including riders with pipes.

I say try to contest it, but I wouldnt be too confident seeing how much they are cracking down on exhausts this year.
 
in the city: yes it can help to be noticed....and piss off everyone driving/living around;)

You're generalizing, picturing some squid on an R1 (definitely his first bike) with a mohawk taped to his helmet revving it on Crescent. In the city i try to be as quiet as possible, its on the highway that people move, look twice or simply notice me next to them and are more careful. I rode my bike before and after exhaust and I definitely see a difference. But I also know what you mean when they piss you off, they piss all of us regular guys as well by attracting unwanted attention + pissing off people nearby.
 
The law is 92 db idle and 100db with throttle variation with a max of 5000 rpm give or take 250 rpm for a 4 cylinders bike test.
 
That's the thing...i'm not some guy who guys around revving the crap out of my bike at lights or anywhere for that matter. If anything, when im city driving i'm always changing gears at really low RPMs. By 60km i'm already in 4-5th gear. When i leave my house in the AM, i actually roll the bike down to the corner, start it and leave. I don't even let it idle. Cops should have a certain discretion. Check my record, check the way i'm driving when you see me then issue me the ticket. I haven't had a ticket in close to 15 years. This cop gave me a ticket NOT for excessive noise but because the exhaust was an aftermarket exhaust.
