Sanction pour RD ?

Hey, so its simple
i got pulled over for my exhaust, 2 cops pull up and start talking to us i told her i had the M package so the exhaust comes like that they say ok take our papers and go in the car and come back, the cop see's the corner of a box in my car and asks what it is
my friend smart how he is, he knew there was a RD in there, he pulls out the box from under my seat and goes Whats in this box? im like ........ jai des photos de ma blonde nu dedans (LOL) and i didnt wanna show him and he was like faut jvois faut jvois i was like no u need a warrant u cant just come and watch to check everything in my car blablablbal he was like theres a gun in there or theres cocaine

so after a while he comes on my side fo the car and grabs the box from my hands ( i wasnt gonna fight for it) and hes like ah c un detecteur blabla cest illegal, goes and gives me a ticket of 650$

now my question IS

i did NOT Lose any points in this ticket, am i supposed to lose any points ?

and should i contest the ticket? i want my RD back , he has no right to take it from my hands without knowing what it is , he tought it was a gun or drugs but still was acting all cool and shit no stress

and what if im supposed to lose points? if i contest the ticket and go to the court and the judge sees i got the ticket with no lost points, will he make me lose my points?

this is in NO way my fault, if i didnt have my friend next to me pull out the box in front of the cop this wouldn't have happened

TU as le droit d'en posseder un mais pas d el utiliser . Tant qu'il n etait pas en marche a ma connaissance tu ne risques rien.

Si c'était vrai, ils pourrais jamais donner ce genre de ticket car tout le monde les débranche et les range quand ils se font arrêter.

The law is simple: You can't have a RD in a car in QC. I'm sorry but you can't fight this one. Buy a new RD and change friends.

The good news is you won't loose any points.
 
it was concealed in a box, he doesnt have the right to search it. If you had a camera, it would be easy to fight but now its his word against yours so good luck

De toute façon, il n'as pas le droit.... j'me suis fait prendre un sac qui dépassait de ma poche de kangourou lorsque j'était encore assis dans mon char (la policière à entrer sa main dans mon char, dans ma poche, pour prendre le sac qui dépassait, elle n'était pas dans son droit, j'ai gagné en cour, j'pense que c'Est sensiblement la même chose....

et criss que ton ami est jambon ! (tu lui feras le message ;) )
 
yes , everything is in the box , the rd the cable everything it was closed in the box , he came on my side and hes like donne moi sa , puts his hand and takes it by force, i didn't wanna hold it and have both of the cops try to force it from me, already that he was leaning on the car and im like yo dont lean on the car man and he didn't seem to give a fuck , i didnt want both of them to do something stupid
 
also, next time dont open your window all the way, the officer has no right to enter your vehicle (not even his arms!) unless he sees something illegal in plain sight.

Corriger moi si je me trompe mais un policier peut fouiller un vehicule si il a un doute raisonnable.

En d'autres termes, ils peuvent fouiller quand ca leurs chante.

ça prend quand même un motif pour faire une fouille style odeur de marijuana ou baggies vide dans le char ou encore autre chose de suspect. une simple boite d'apres ce que j'ai su c'est pas assez mais je peu quand même être dans l'erreur. ils ont le droit de te demander ce qu'il y a dedans. Moi je me suis fait souvent demander : Qu'est ce qu'il y a dans ton sac de sport ou encore quand j'avais des boite dans l'auto la même question. si tu repond pas quelque chose de stupide en hésitant il va pas aller plus loin. c'est sur qu'avoir des photo nue de sa blonde dans une boite en dessous de son siege de char ça sonne sketch...
 
Autrefois .l utilisation du radar etait interdites. Maintenant le seul fait d en avoir un dans le char est interdit

En effet selon moi les manœuvre du policier etait interdites voir tread de vitre teintées j y est mis des jugements

Et pour ceux qui on pas compris...lol et un policier qui a pas compris ca devrait allez se rassir sur les banc d ecole

Un citoyen n as pas a cooperer et le fait de ne pas le faire ne le rend pas suspect

Ca veut simplement dire qu il c est deja fait crossez par des policiers ... idem le cas present ....je suis sur que le op va etre cooperatif le prochain coup...
 
Sa t'es revenu cher avoir un detecteur pour 2 semaines. Sa t'as tu sauver un ticket de vitesse au moins?

If for any reason the cop had reason to believe that you had a radar detector in the car then he would be justified in searching it as per the CSR, which has provisions for searching a car to find a radar detector. IE: Instant On radar, your car nose dives.

If however, he had no reason to believe that you had a radar detector he would've needed reasonable and probable grounds to believe you have committed offences under the criminal code (gun) or controlled drugs and substances act (drugs) and exigent circumstances to search your car without a warrant

Oublies la récupérationde ton dr ....c'est pour eux un des pires crimes de l'humanité ...naz

Aucun point pour un dr.

Tu peux aller en déo mais tu investiras du temps et des émotions ....paye et apprends à cacher
tes choses et choisis mieux tes amis ....d'ailleurs il devrait t'en payer un autre : il est le coupable...

Curieux de savoir la marque et modèle ....et combien tu avais payé .

Un conseil : même si c'est un grand plaisir de modifier son auto ....vaut
mieux rester low profile ....

je vais aller en cours et leurs expliquer la situation et je vais dire je veux pas ravoir le RD , juste mon ticket annuler..

si seulement mon ami aurais jamais sorti la boite en dessous du siege..

est-ce qu'il a le droit de me l'enlever des mains sans savoir ce qui se trouve dans la boite?
 
il a pas le droit de rentrer dans ton char sans t'avoir au préalable demandé l'autorisation. point final.

à moins d'avoir un doute raisonnable qui mettrait sa vie ou celle de son coéquipier en danger.

tsé, si on change un peu les informations ... tu as un manteau sur le banc du passager, et il semble y avoir quelque chose en dessous. le policier n'aurait pas le droit de rentrer ses bras dans la voiture pour soulever le manteau pour voir ce qu'il y a en dessous.
le même principe s'applique à ta boîte.

il doit te demander l'autorisation, ou te demander de l'ouvrir simplement. et tu as le droit de lui demander pourquoi et de refuser de l'ouvrir. il doit alors avoir un mandat de perquisition pour la boîte.
 
seriously guys...where all your information come from? did you guys ever read the csr? I bet 99% of you are talking without knowing how it works lol
