Where I have a problem, is when those neighbours paid a fair market price taking in account there will be noise from the track.
I'll use a car analogy: You buy a damaged car from an insurance company that was rear ended in an accident. You pay fair market value for the car taking in account the repairs involved to get it back on the road.
But instead of paying the damages you sue the guy who rear ended the car so he pays to repair the car for you.
That would make no sense.
Just like in the case of tremblant, here we talk about a track but really it could be anything else. Opening a door here would be also detrimental for many other things.
